Requirements

Remote work for a non-Spanish company or self-employed with non-Spanish clients, supported by a valid employment or freelance contract.
Minimum monthly income of approximately EUR 2,650 (exact amount depends on the size of the family).
Proof of a university degree or at least three years of relevant professional experience.
Private health insurance.
Clean criminal record.
Renewal requires evidence of continued remote work, sufficient financial means, valid health insurance, and at least 183 days of residence per year.

What is an international teleworker or digital Nomad in Spain?

A worker authorized to remain in Spain to carry out work or professional activity remotely for companies based outside the national territory, through the exclusive use of computers,
telematics and telecommunications mean and systems.

Who can obtain authorization as a digital Nomad visa in Spain?

A national of a third country, of legal age. (This does not apply to citizens of the European Union or those to whom European Union law applies)

Can a self-employed person be considered an digital nomad?

Yes, provided you can prove a professional relationship through a commercial contract with the foreign company you work for for at least 3 months. That company authorizes your transfer to Spain.

Is Social Security registration mandatory in Spain?

Yes, when carrying out work activity from Spain, registration is mandatory, and there can be two cases:
– Employee: The company must register with Social Security to register the teleworker under the General Scheme.
– Self-employed worker. The worker must register with the self-employed workers’ scheme (RETA).

If the company has a branch in Spain, can I register them with social security through that branch, or can I import the right to social security from countries with agreements based on that transfer?

In that case, they would not be considered teleworkers, but workers transferred between
companies (Intra-Company Transfer), governed by that figure and its specific requirements.

Can they do other jobs in Spain?

As a Spanish digital nomad visa holder, you can work from Spain provided you respect the following limits.
– Employment relationship: In Spain, you can only work for a company based outside the national territory for which you perform the service remotely.
– Professional relationship: You may work for a company located in
Spain, provided that you maintain a professional relationship with the company for which you are requesting authorization, and the percentage of said work with the Spanish company/s is a skilled
relationship (never employment) and does not exceed 20% of your total professional activity.

Can family members obtain authorization/visa?

Yes, the spouse or person with a similar relationship of affection, minor children or older children who, being economically dependent on the holder, have not constituted a family unit themselves, and dependent ascendants, who join or accompany the foreigners, may request, jointly and simultaneously or successively, the authorization and, where appropriate, the visa.

Can family members work in Spain?

Yes, the fourth additional provision of Law 14/2013 establishes that residence permits authorize residence and work (both self-employed and employed).

Do minimum economic resources (means of subsistence) need to be proven?

Yes, applicants for international teleworking visas or residence permits must prove that they have sufficient financial resources for themselves and their family members according to the following amounts:
– Holders of visas and residence permits: a sum that represents 200% of the minimum interprofessional wage (SMI) every month
– Family units that include two people, including the main person and the person reunited, account for at least 75% of the SMI. An additional 25% of the SMI will be required for each additional member beyond the two mentioned.

Do I need health insurance to apply for the Spanish Digital Nomad Visa?

If you are self-employed (autónomo) and will be registering with the Spanish Social Security system, you do not need to take out private health insurance, since by paying your self-employed contributions, you will have access to Spain’s public healthcare system.
However, if you are coming as an employee of a foreign company and working in Spain with an A1 certificate, it is recommended to have private health insurance that meets the visa requirements, since in this case you will not be directly contributing to the Spanish Social Security system.
